MOURA STARR - TERMS AND CONDITIONS

A. PRICES
a. All prices are F.O.B. New York, NY or Los Angeles, CA.
b. Prices do not include tax or delivery.
c. Buyer must provide a valid resale certificate at the time of purchase or sales tax will be applied to invoice.
B. CUSTOM ORDERS
a. 50% Deposit due at time of order for purchases over $5,000. If purchase totals less than $5,000, 100% is due at time of order.
b. Remaining balance due in its entirety upon item(s) shipping from factory.
c. Custom orders require special labor and materials and cannot be cancelled.
d. No refunds. Furniture, lighting and flooring orders are non-returnable. Store credit will be issued for returned items minus a 20% restocking fee.
C. PURCHASING ITEMS FROM FLOOR
a. Returns will only be accepted within 7 days of purchase if merchandise is in the same condition as when sold to the client.
b. No refunds. Store credit only will be issued for returned items minus a 20% restocking fee.
D. CANCELLATION POLICY
a. Orders are processed immediately and cannot be cancelled at any time.
E. C.O.M.
a. Extra C.O.M. will not be returned.
b. Moura Starr is not responsible if C.O.M. is not properly labeled or side-marked which may result in production delays and/or delays in delivery time.
c. Moura Starr reserves the right to reject customer's C.O.M. and may request additional fabric after the factory has assessed the C.O.M.
d. Moura Starr cannot be liable for any flaws in C.O.M. or C.O.L.
e. Moura Starr doesn't accept returns in C.O.M or C.O.L
F. FABRIC & LEATHER
a. Moura Starr is not responsible for fading, shrinking or cracking.
b. Slight color variations must be expected.
c. Leathers and furs are unique samples of nature and characteristics will vary. Imperfections in the skin are normal and cannot be considered a manufacturer's defect.
G. DELIVERY TIME
a. Special Orders
i. Delivery time is subject to stock or availability of materials needed for production.
ii. Lead time is subject to change without notice.
iii. Custom orders and/or dimensional changes require additional time.
b. Floor Purchases
i. Items purchased by check require 10 days for processing before product can be released from floor.
H. SHIPPING & DELIVERY
a. MOURA STARR IS NOT RESPONSIBLE FOR ANY DAMAGES INCURRED DURING DELIVERY.
b. Client is responsible for inspecting all merchandise AT TIME OF DELIVERY. In case of any damages or defects, missing parts, details must be noted along with signature of acceptance and report to Moura Starr within 24 hours after delivery. This enables Moura Starr to file a claim with the carrier. Should damage occur, Moura Starr will facilitate all clams and see that proper repair or replacements occur. (As long as a client has used Moura Starr's recommended delivery service). Should client choose to use another source of delivery service- Moura Starr will not be responsible for delays, damages, claims, or repairs.
i. Any damages or defects discovered after signature of acceptance become the client's responsibility and is no longer insured by the carrier. The name and number of a local Furniture Medic may be obtained by calling your Moura Starr sales representative.
1. Casegoods are sealed with Polyester. This is important information for repairs.
c. Client is responsible for knowing limitations for home or building and all measurements relating to pieces fitting their projects. Moura Starr is not responsible for measurements relating to customer's elevator, hallway or staircase for delivery and installation.
I. WARRANTY
a. Moura Starr uses the finest materials available which allows us to offer the best quality possible. Moura Starr furniture goes through inspections at all stages of the manufacturing process. Every item is warranted to the original purchaser that the product is free from defects in material and workmanship upon delivery to the carrier.
i. In no event will Moura Starr be liable for indirect, special or consequential damages.
ii. In no case will Moura Starr's liability exceed the price of Moura Starr's merchandise.
b. Casegoods Frame and Construction: 3 Years
c. Upholstery: See sales representative as warranties vary.

Should any legal action arise from this agreement, the prevailing party to any such action shall be entitled to such party's reasonable court costs and attorney's fees incurred, further, the proper venue for any such action shall be Los Angeles, CA, which is the location of the headquarters of Moura Starr and all parties hereto do hereby submit to said court's jurisdiction for all purposes.
